Steps For Filing a Divorce
Before starting the steps for filing a divorce, there are some divorce considerations such as child custody, or child support. The effects of divorce should also be considered. Once the "D" word is used in a relationship, many paths can be taken. Depending on how serious the situation is, proceedings can happen rather quickly. However, if there are children involved and the parties want to think through this situation, try to reconcile or live with the conditions causing the consideration of divorce, proceedings can be delayed.
In today’s world, divorces are sometimes considered to happen too easily. However, in the past many couples stayed together even though they should have separated for the sake of the children. So there needs to be a happy medium in the view of whether divorce should proceed or be delayed. Too many factors that go into considering divorce and every situation can be thought of as unique.
Divorce
It is best however to know what to expect even before considering using the “D” word. Knowing the ramifications, the timelines, the process that will be required by the courts and all the other non-legal things that need consideration should be contemplated.
There should be a course in college, or required of every couple before they are married, in divorce, so that the couple knows this is for real and the “getting out of it” process isn’t quite as simple as breaking up with a girlfriend or boyfriend. The steps to filing for divorce must be taken are quite a bit more involved than not answering their calls
There are considerations that might not be relevant to your situation, but if you’re learning about divorce in hopes of never needing one, then go at the learning process as if you have to take a test to pass marriage counseling and you’ll come out of the process at the other end ready to be a marriage counselor! Consider this job training, just not on-the-job training!
Divorce Considerations
Consider all these areas when learning about divorces:
- Is a Divorce something you really want or need?
- Are the conditions indicating a divorce is needed contentious, requiring a Lawyer?
- What will you have to document for the courts and lawyers?
- Prepare for the realities of a receiving a Separation Agreement, responding to a Summons and preparation of a counterclaim
- Allocate some time for the discovery phase and take the money you’d earn during that time out of your budget
Consider the ramifications of:
- Division of Property
- Financial Support
- Child Custody
- Visitation Rights
- Decision on if you can handle a settlement or afford a trial
Details about all these areas can be researched as needed unless you’re going for the marriage counselor degree that is!
When learning about these areas be sure to take into consideration the affects that a divorce would have on children and make sure that the needs of the children are primary and listed at the top of the list to be addressed. Making sure that the children can be well taken care of (alimony and child support considerations), will have equal access to the other parent, who is best qualified to provide support through custody of the children, and how the children’s college education or other special needs will be addressed.
