Child Custody During or After Divorce

Some child custody factors are weighed in the best interests for the child. Child custody during divorce can change or be the same as the child custody after a divorce. Each state regulates its own child custody rights. Unfortunately no matter the state you live in, custody can be a long and painful battle for both you and your children. A divorce attorney can help inform you of your custodial rights for the state in which you live while simultaneously dissolving your marriage. According to statutory provisions, both children's parents have equal custodial rights unless other circumstances are relevant.

Based on the best interest of the child or children, if the parents are unable to agree upon a custodial resolution, the court may need to decide custody.

Child Custody Decision Factors:

Sole custody consists of one parent taking on full responsibility of the child concerning care and decision making. This parent is usually referred to as the custodial parent, whereas the other parent is considered the non-custodial parent. Non-custodial parents still have visitation rights, based upon the circumstances. Visitations can consist of overnight visits as well as vacation periods. In a joint custody decision, both parents share the responsibilities as well as the decision making on behalf of the child or children. A child custody attorney and/or divorce attorney can assist you with any questions you may have concerning the form of custody you wish to seek.
