An affidavit of consideration is defined as any written statement of factual nature, which is made under sworn oath with penalty of perjury and witnessed by notary and others, that outlines a number of pieces of information or details transactions. The affidavit of consideration in divorce cases is used to certify the receipt of property that was once jointly held marital property, prior to a divorce proceeding and decision. The affidavit of consideration basically outlines all property received by a given spouse following the dissolution of a marriage, and in turn, legally entitles them to ownership of this property, even in spite of future legal claims against the ownership of the property by an ex-spouse.
