Alimony Laws

Alimony laws allow a family court judge to order one spouse to make payments to the other in the event of separation or divorce. This may apply when the assets in a marriage cannot be adequately divided in a manner that reimburses one spouse for his or her contributions to the relationship. These laws apply equally to the husband and the wife. However, since men usually have higher actual or potential income, it is generally the wife who is awarded alimony. There are several different types of alimony (also called spousal support or maintenance). Temporary alimony may be awarded during a separation period. Or, a lump sum may be paid at the time of the divorce. Rehabilitative alimony is designed to be paid for a limited period of time in order for the payee to become financially self sufficient. Permanent alimony may continue until the death of either party or the remarriage of the payee.
