Every state has formal grounds it will recognize for divorce or annulment. For annulment in Georgia, a couple or single spouse can claim that bigamy, duress, fraud, underage, mental incapacity or consanguinity (incest) makes their marriage void and invalid. The proof or documentary evidence that their claims are true must come from them and also be from valid sources. For example, if someone was under the age of 16 at the time of their marriage and did not have a formal document of parental consent, they can seek to have the marriage erased from the public record and made legally invalid. Georgia is known as a somewhat difficult state to win an annulment, but if the grounds are valid and evidence available the courts cannot deny the request.
