Annulment Grounds

Annulment grounds are conditions that allow a couple to void or nullify a legal marriage rather than dissolve it by going through a divorce. A legal annulment can be most easily obtained when the marriage has existed for less than a year. If one spouse is impotent and the other was not aware of this fact prior to the marriage, this can be grounds for annulment. So can a failure to consummate the marriage for reasons other than impotency. In cases where one spouse has withheld important information (such as a drug addiction or criminal record) things get a little more complicated. If the deceived spouse accepts the revelation of new information and continues to live with the other spouse, this can indicate to the courts that he/she is OK with the situation. Then, a divorce is the only option for legally dissolving the relationship. Second marriages in which one spouse is still legally married to a previous spouse can be annulled even if the second spouse was aware of the bigamous nature of the relationship.
