Annulments

Annulments are used rather than divorces when a couple wishes to void or invalidate a marriage. Unlike a no-fault divorce, an annulment must be justified. The specific requirements vary from one state to the next. If one spouse was already married to another person and fraudulently filled out a marriage license in order to marry a second individual, this is considered grounds for an annulment. A marriage can also be voided if a minor marries without parental consent or if two people who are related marry each other. Couples who wish to have a short marriage (of less than a year) invalidated are more likely to be successful than those who have been married for longer. Religious and legal annulments are not identical. Just because a couple is able to get one kind granted does not mean they will qualify for the other. Children born during a marriage that is later annulled are considered legitimate.
