Calculate Child Support

Courts generally calculate child support based on a variety of factors. These include the level of income of the non-custodial parent (NCP), the monthly state minimum for child support, and the needs of the child. In some states, the income of the custodial parent may also be taken into account in determining how expenses will be covered. The standard of living the child would have enjoyed if the parents were not separated or divorced may also be considered in order to calculate child support fairly. In cases of joint custody, the parent with a higher income level may be required to pay child support. If a non-custodial parent is incarcerated or otherwise incapacitated, the NCP might not be required to pay support depending on state guidelines and other considerations. The family courts attempt to calculate child support so that the NCP can still pay his/her own living expenses; but the needs of the child do take precedence.
