Child Custody Issues

When a court is presented with a child custody case, they will evaluate a variety of issues when rendering a final legal decision. The family court judge will render a decision in which they believe is in the best interest of the child or children involved in the divorce. Some of the child custody issues considered include: Financial means of both parents- the ability to support the child; Environment and living situation of each parent- most couples move out of their family home when they are divorcing. In the event that one parent stays in the family's home, many courts lean toward not removing the child from the home if that parent retains custodial rights; Stability of the parents- Things such as how often they move, their job stability and their emotional stability are taken into consideration; Siblings- If there are other siblings, many judges will award custody of the child or children of the divorce to this household to keep the family together.
