Child Custody Visitation

Even in cases of sole child custody, visitation rights for the non-custodial parent (NCP) are generally granted. Sometimes, this can happen even if the NCP has a history of abusive behavior. Some custodial parents believe that supervised visitation is an adequate solution if the non-custodial parent has a violent past. However, supervision is usually only ordered for a brief period of time. If there are no apparent problems, the NCP may then be granted unsupervised visitation. Because of this, a custodial parent who believes his/her child is at risk for abuse (or abduction) should seek qualified legal advice to limit or eliminate visitation by the non-custodial parent. The amount of shared parenting can affect the level of child support that is ordered in many cases. However, parents should not seek joint custody or more visitation days simply to reduce the amount of support they must pay. This can have unintended legal consequences - especially if it can be shown that the parent is neglecting the child's welfare during visitation periods.
