Child Paternity

When a mother is requesting child support, setting visitation rights or is child custody, paternity is a crucial factor. While children resulting from wedlock are often not a paternity concern, children born outside of wedlock may require a paternity test to validate a financial claim from the mother. Parents can work through child paternity on their own, outside of the court room, or they may involve a court to order a paternity test if required. In the event that the test comes back positive, the mother does not have the right to sue for back child support as there was not a legal agreement in place prior to the test results. When a paternity test comes back positive, the mother has the right to seek financial support in the form of child support and discussions regarding child custody and visitation can begin if desired.
