Child Visitation

Every parent has the right to visitation with their child. Depending upon what state you live in, you may still have visitation rights even though you may be behind on your child support. It is in the child's best interest if they have both parents in their lives. The courts will always look at what is in the best interest of the child and in some states; they could even ask the child for their opinion. Visitation rights can be agreed upon by both parties and then be sent in front of the judge for the ruling. If the visitation rights are agreed upon, the judge will definitely rule in favor of the agreement. Standard visitations can be set at every other weekend, at least. You can, however, get more visitations with your child. The courts will consider how far apart the parent's live from each other and take the child's age into consideration whenever they are establishing visitation rights. If the custodial parent refuses to allow the non-custodial parent to visit with the child, a visitation order can be established by the courts by filing a petition with the court system.
