Child Visitation Laws

Child visitation laws ensure that non-custodial parents are not denied access to their children without adequate justification. Most custodial parents do not attempt to prevent visitation. Couples generally reach agreements about visitation privately instead of handing this decision over to the courts. This is often the best solution since the "one size fits all" schedules imposed by state guidelines don't work for every family situation. The courts can still review and approve a visitation or shared parenting agreement to ensure that the welfare of the child is being given priority. If the court issues a visitation order, it is legally binding. Neither party can violate the order without risking legal consequences. Contempt of court charges can be brought against a custodial parent who refuses to present a minor child for his/her visitation time with the non-custodial parent. Kidnapping charges are a possibility if a non-custodial parent refuses to return the child to the custodial parent.
