Child Visitation Rights

As a result of the finalization of a divorce, child visitation rights may be granted to the other spouse, or to interested family members such as a grandparent. These rights offer the ability for individuals to spend time with a child of divorce. Most courts will allow the couple to develop their own visitation schedules, although they will step in during difficult divorce cases when the couples cannot reach an agreement. Ultimately, the best interests of the child or children are taken into account when determining visitation schedules. Most courts when awarding visitation rights will award rights to the non-custodial parent, leaving flexibility within the specific times and dates up to the couple. This allows for schedule flexibility between the schedules of both parents and the child.
