Collecting Child Support

Following a court order for a parent to pay child support, there are some instances in which the party decides or is unable to pay. The first step most legal professionals recommend taking is to discuss the issue with the other party in an attempt to resolve it without the state's or court's involvement. In the event that this is not possible, there are other steps available for collecting the funds. If the party is employed, the parent can simply file a withholding order with their respective state. This order allows for automatic deduction and payment of child support to be facilitated directly with the individual's employer. There are other options available for collecting unpaid child support, including taking the other party back to court which can result in a payment or a judgment. In the event that the non-paying party owns property, many states will permit you to lien against this asset as collateral for the funds you are owed.
