If you go with this avenue, when signing the paperwork, you must make sure that you and your spouse sign the papers in front of a notary public before filing the forms with the courts. When filing the forms with the courts, usually there is a filing fee that must be paid. The forms will then go in front of a judge to be ruled upon before the actual divorce is considered finalized. If you fail to file the forms, your divorce will not be legal until you complete all of the steps of the legal process.
