Divorce Process

Each state has its own specific guidelines regarding time limits for filing for divorce and how long it takes to complete the divorce process, but the basic procedure is that one person files the paperwork and then a hearing is scheduled. In many divorces, especially those where children or large amounts of property or money is involved, it is recommended that both parties seek legal advice. If there are no children and no contentions about property, etc. there may be no need for attorneys at all. In these cases, the do-it-yourself forms are filled out and signed by both parties, reviewed by the courts and if everything is correct, the divorce is signed by a judge and then finalized. The divorce process may become more complicated if there are children because of the need for custody agreements and child support orders. Large amounts of cash or property may slow the case down too as each side tries to work toward a deal that is most beneficial for themselves.
