Florida Child Custody Laws

The Florida courts will approve or render child custody decisions which are in the best interests of the child or children involved. Once the couple presents the facts to the court, a decision will made, equally considering both parents, with regard to the both legal and physical custody. Legal custody refers to parental decision making rights in regard to the welfare of the child, typically covering issues such as medical care and their education. Physical custody refers to the actual, physical location in which the child will reside. Custody can be awarded on a sole or joint basis. Some of the factors taken into consideration when rendering a child custody ruling include: The current emotional bonds of the child and the parents; The mental and physical capacity of the parents; Other siblings; Where the child currently resides and with which parent; Any evidence of child or domestic abuse within the household; The financial capacity of both parents; Parenting abilities of both parents.
