Florida Grandparents Rights

Florida grandparents' rights laws are very clearly defined and demonstrate preference for parental choices and decisions. For instance, any visitation schedules are usually those of the parents, rather than the grandparents, and this is something upheld by state law. Additionally, it is up to the grandparents to demonstrate to the courts that granting visitation is in the best interests of the grandchildren. The court system does recognize Florida grandparents' rights, but uses several factors to determine whether or not visitation is good for the child or children in question. The courts will assess the existing relationship between the child and grandparents and that of the parents and grandparents; the effects of visitation rights on the parent-child relationship; the interference in parental visitation that might occur from the granting of grandparent visitation; and any history of abuse.
