Grounds for Annulment

Annulment is a method of terminating a marriage which differs from a divorce. Annulment refers to a process whereby a court nullifies the marriage, essentially declaring that the marriage never took place. In order for the court to grant an annulment, the individual or couple must meet certain criterion as outlined. Here are some of the most common grounds for annulment: One party was under the legal age requirement at the time the marriage took place; Lack of capacity to marry; Fraud committed by one or both parties; One party being forced or threatened into the marriage; Mental incapacity at the time the marriage took place; If one party was not aware that the other party had incurable impotence prior to entering into the marriage. Grounds for annulment must be presented to the respective court by the innocent party for consideration.
