Guardianship Lawyer

The legal definition of guardianship does not indicate the parent-child relationship. Usually it describes a situation in which parents have lost their legal rights to make serious decisions about their child's life, and also custody of the child as well. Anyone who is dealing with such a scenario is well-advised to hire an experienced guardianship lawyer to help them re-establish their parental rights if possible. Most guardianships turn the raising of the child over to the assigned guardian, though this does not mean that the legal parents no longer qualify for visitation or contact. It does mean that parents will have to accept monitored visitation if they hope to somehow regain custody of the child at a later date. When a parent is at risk for losing custody of their child to a guardian, they are usually given several warnings in advance of any legal action. It is at such a time that the parents should seek out a guardianship lawyer to help them as much as possible.

Fast Facts

  • A guardianship can be assigned on an emergency basis, but most situations involve several formal hearings before the child is removed from parental care.
