Laws on Child Custody

Every state has a different set of laws regarding child custody. Child custody refers to two primary issues, legal and physical. Legal custody refers to specific issues such as medical care or education, and the parent awarded this form of custody is responsible for making decisions which are in the best interest of the child. Physical custody refers to the physical location in which the child is residing. Physical custody can be on a sole basis, or can involve both parents on a joint basis. Most parents will agree to custody arrangements on their own, without the necessity of involving a mediator or the family courts. But, in the event that the couple cannot agree to custody terms on their own, they will schedule a hearing with the appropriate family court. A judge will listen to the case and render an opinion which considers the best interests of the child in question.
