Legal Separation Florida

Couples who are considering divorce often separate for a period of time, either to work on their marriage in hope to work through any issues, or in order to resolve all marital issues which need to be covered in the final divorce decree. Florida does not address legal separation in particular within their family court system. But, there are provisions which cover the following issues: child support, child custody, child visitation, spousal support and the division of marital assets. Florida is an equitable division state, meaning that assets acquired during the marriage will be distributed equitably (fairly), not necessarily equally between both spouses. Most individuals within the state of Florida who file for legal separation are concerned more about spousal support during the separation period and issues surrounding their children, rather than the distribution of assets. Most Florida couples are able to decide on the terms of their legal separation agreement without the assistance of the family court system.
