Usually, both parties must file the appropriate paperwork and submit the evidence that they wish the court to review in order to make their determination about the validity of the request. For instance, if one party is pursuing the annulment after discovering their spouse has an active criminal career, they must be able to demonstrate proof of this in order for the court to be able to legally grant the annulment.
