In regards to divorce laws, a military divorce is the dissolution of a marriage where one or both members of the marriage part of the military, either in active duty, reserve duty, or retired. In the context of the courts and legal doctrines, military divorce is not a technical term, but has entered the lexicon of divorce due to the variations in some state laws regarding statutes making it easier for military members to maintain residency or complete divorce proceedings. Divorcing military couples also face decisions regarding benefits, pension, and pay that normal civilians might not face, and in turn, some of these pension arrangement fall under federal and not state laws.
