When a couple with children divorces, if the child is under the age of majority, parental custody must be agreed upon and filed with the appropriate family court system. In the event that the couple cannot agree upon parental custody, the court will step in and render a decision in which they believe is in the best interest of the child or children involved. Some of the factors that the court takes into consideration when deciding upon parental custody include: The emotional bond of the child to one or both parents; Parenting skills exhibited of either parent; The schedule of the parent; Physical health of the parents. While these factors are not the only things taken into consideration, they do provide a general framework for the judge when considering parental custody.
