Paternity Laws

Paternity laws govern the rights of fathers to establish custody and visitation with their minor children. These laws also give men the prerogative to demand genetic testing before being required to pay child support. Such tests are highly accurate, but men do have the right to pay for retesting if they believe that the results were not valid. The mother, father, and child are all tested if the courts step in to determine paternity in order to collect child support. In most cases where the parents of a child are married to each other, the father simply lists himself on the birth certificate. If a father is tracked down later through social services, the social worker may ask him to sign a voluntary acknowledgement of paternity. The legal ramifications of this decision should be explained to the father at this time. A man who voluntarily acknowledges paternity is waiving his right to genetic testing. The child whose paternity is acknowledged gains inheritance rights and the right to child support from his/her father.
