Premarital Assets

Pre martial assets are those assets that each spouse had obtained or earned on their own prior to entering into a marriage. These assets will include items such as income from investments, salaries, property, and other assets, as well as claims on inheritances, potential gifts, and other derived revenues from other sources that were established before a marriage. Typically, pre marital assets are deemed non marital property, which disallows a spouse from laying claim on these assets in the event of a divorce.

Fast Facts

  • Most states posses their own laws regarding the division of assets following a divorce, however, almost all states recognize the validity of separate premarital assets.
  • Premarital assets may also be clearly outlined as non marital assets in a prenuptial agreement.
