Separation Agreement

A separation agreement, in the context of divorce law, is a legally binding agreement between two spouses following the commencement of a legal separation, which has been granted by the courts. Additionally, a separation agreement may be made between two spouses with legally binding affect if both parties live separately and eventually wish to divorce. A separation agreement deals with issues such as division of assets, child custody, child support, taxes, insurance and healthcare, visitations, and debt obligations. Additional considerations required given the specific nature of the relationship between the two spouses may also be included.
