Couples seeking or considering a divorce do not have to file a legal separation agreement form with the appropriate family courts, but it is an option for those individuals looking to protect their assets, interests and children during the divorce proceedings. Couples can either file the required separation agreement form with the family court, or in the event that they hire an attorney, they can do so on behalf of their client. Most couples agree to the terms of a separation agreement without the assistance of a mediator or divorce attorney. But, in the event that the couple cannot reach agreement on their own, the family courts can step in to hear both sides of the case in attempt to render an agreement in which both parties will sign.
