Summary Divorce

Just as it sounds, a summary divorce is a simplified version of legal divorce. Not all couples can qualify because a summary divorce is only possible when the marital assets are simple and uncomplicated as well. For instance, most states require that the couple must have no children, have been married for only five years or less, has no "real" property or a mortgage, has assets valued at less than a certain amount (which varies by state), and neither is seeking spousal support. Even if there are children or assets of a greater value, many states will permit a summary divorce to proceed if both parties sign documents demonstrating that they have already reached an amicable division of the property or made parenting and custodial plans as well.
