Temporary Custody

Temporary custody is transient custody given to one parent or another party that is meant to be exactly that - temporary. No matter what the reason for removing the guardianship of the children from the legal parents, temporary custody is granted so that the children are protected and well cared for until a more suitable, permanent arrangement can be found. In some cases, it is because of legal, financial, emotional or health issues with the parent or parents; in other cases it is for the best interest of the child that the custody is removed and given to someone else. Temporary custody may be given to other family members (including adult siblings, grandparents, aunts and uncles), a court appointed entity or a social services organization. Temporary custody will be ended and the children returned to their parent/parents when the judge feels that it is appropriate and all court-ordered conditions have been met. Judges may take the opinion of the child in consideration for matters of custody based on the age and ability of the child to give them.
