Types of Divorce

Each state will offer more than a single way to get a divorce, but not all states will use all of the types of divorce available. A simple list of the most common types of divorce would begin with the "uncontested" type. This is when both parties agree to end the marriage and work together or with attorneys to divide assets and make arrangements for child custody, and support payments. There are also "no-fault" types that place no blame on either party for the condition of the marriage and the need to end it legally. Where "fault" divorces still exist, there is usually the need for the party filing the petition to somehow demonstrate why the other is to blame. There are also collaborative types known as "do it yourself" divorces that allow couples to end their marriages amicably and with the minimal amount of time spent in a court room.
