Virginia Annulment

Virginia is a state that accepts annulment requests in their court system. A Virginia annulment will void the marriage and remove it from the records, but it will not establish any children born to that marriage as illegitimate. It may, however, negate any claims on marital assets since the marriage is viewed as never having existed and therefore not offering either spouse a claim on what were once jointly held belongings or income. To seek a Virginia annulment, one or both spouses must have an acceptable and valid claim, including bigamy, consanguinity, underage partners, prostitution, fraud, duress and impotency. The burden of proof will lie upon the couple, and all formal deadlines and documents must be met for the court to consider and rule on the filing.
