In order for a Virginia no fault divorce to proceed, both parties must have come to formal agreements about the handling of property, assets, debts and all issues around any children born to the marriage. These arrangements must be itemized in a Property Settlement Agreement that is submitted to the court well in advance of the date that the divorce will be considered by a judge. This means that one will have to file a complaint and become a plaintiff, while the other becomes a defendant.
