Virginia No Fault Divorce

In order for a Virginia no fault divorce to proceed, both parties must have come to formal agreements about the handling of property, assets, debts and all issues around any children born to the marriage. These arrangements must be itemized in a Property Settlement Agreement that is submitted to the court well in advance of the date that the divorce will be considered by a judge. Even if the couple has created this agreement, their Virginia no fault divorce must still follow a very rigid set of requirements to be finalized. This means that one will have to file a complaint and become a plaintiff, while the other becomes a defendant. The complaint is legally served to the defendant and both parties will eventually need to work with an attorney in order to register their formal depositions. Only then can a judge issue a final decree and make the Virginia no fault divorce fully legal.
