Visitation

Visitation is when one parent, as a result of a divorce, receives legal, court-issued rights, to visit and spend time with his or her children. As a parent, you have every right to see your children, no matter if you pay child support or not. Your ex-spouse or partner cannot legally withhold your child from you. Visitations are set through a court order by a judge. They can either be supervised or unsupervised, depending upon the situation. Depending upon the custody arrangement, visitations can be set equally between both parents or one parent may only see the child as seldom as a few days a month. The court will decide upon what is in the best interest of the child. If both parents can agree to a visitation schedule, the courts will usually rule in favor of the agreement. In the event of sole custody being awarded to one parent, the non-custodial parent is the one who will receive visitation rights to the child(ren). Visitation rights are not just for the parents, either; they can also be awarded to other family members, such as the grandparents.
