Because of your circumstances, you should consider meeting with an attorney before you do anything else. You will want to file your divorce quickly and make sure everything is done correctly, so an attorney would benefit you greatly. If you want to keep the house and the children, if you have any, you will need to file a temporary order request awarding those things to you through the pendency of the divorce. This will be filed immediately after your Petition for Divorce. If you and your husband are not getting along, you may want to consider doing all of this before you tell him you are filing for divorce. You want to be the first to file and request temporary orders; if he knows you are filing, he could file first. Most divorces can be over with in a matter of a couple of months. However, the more conflict and turmoil, the longer the process usually takes.
