Alternative Dispute Resolution is actually a term used to mean several ways to resolve disputes other than traditional litigation. This may include mediation, arbitration, or even collaborative law. In the case of family law, mediation is the primary method used to resolve issues prior to or in place of litigation.
ADR is considerably less expensive than going all the way through litigation. The reason for this is the amount of time you will save by resolving the case early instead of your attorney having to prepare and argue your case at trial. Both parties are also more likely to resolve the case in a manner they both can live with, because ultimately in ADR, it is the parties that reach an agreement to resolve whatever issues there are.
You can go through ADR with or without an attorney. There are many dispute resolution centers available now to allow parties to mediate even if they are not represented by an attorney.
