Since divorce laws vary from state to state, it will depend on your state laws on the distribution of property. If you and your wife can work out an agreement between the two of you on the division of the company then that would be the best route. Of course things do not always work as planned so it would be wise to consult a lawyer in your state that specializes in Divorce and family law.
If you and your wife cannot reach an agreement then the court will treat the business just as it would any other property by classifying and dividing it as the court sees fit. This is an area where the help of an attorney would be extremely helpful as they can help present your case before the court.
