My husband and I have been married for a long time. I have worked part time during our marriage but I have never made as much as he has. He recently found out I was having an affair and has filed for divorced. Can I get spousal support if I am being divorced for committing adultery?

Being sued for divorce on fault grounds does not mean that you lose your rights to spousal support if spousal support is appropriate. Spousal support can be awarded for several reasons, including but not limited to need, as a means of dividing the marital estate, to allow one of the parties time to get back into the work force or to support a spouse who may need to stay at home to care for a disabled child. Fault may be a factor in how much support you may be awarded, it is up the discretion of the judge.
Your best option is to consult a family law practitioner about your circumstances. He or she will know law and case law history for these types of issues in a divorce.
