My husband and I are going through a bitter divorce, and we have not been able to reach agreement on some important issues. My lawyer says if we cannot settle our differences, we will go to court and a judge will make rulings and order a divorce judgment. What does this mean?

If you are unable to settle your differences and are too far apart in your demands, your lawyer is right to advise you that the next step is probably civil or family court. In a divorce trial, both sides will have an opportunity to present evidence in the form of testimony from you, your husband, and any other witnesses with knowledge of your divorce; and also documents, such as financial records. After the judge considers all the evidence, he will issue a final ruling resolving all the issues, granting the divorce, and enter a divorce judgment which will dictate you and your former husband’s rights and obligations regarding such issues as child custody, property division, and support. If you or your husband fails to abide by the terms of the divorce judgment, you may go to the court that granted you the divorce and file a motion to enforce the divorce judgment. I would suggest following the advice of your divorce attorney.
