Question:

How is an annulment different from a divorce or dissolution?

Answer:

There are a variety of ways that a marriage can end in today’s society.  Annulment, divorce, and dissolution are three typical ways that marriages are undone.  While the reasons for ending a marriage can be varied and very personal, the routes by which a marriage can be ended are specific to the duration of the marriage and the way the marriage was set up.  So what are the rules for annulment vs divorce and under what circumstances should you seek an annulment if you wish to end your marriage, as opposed to going a different route?

  • The main difference between an annulment and a divorce or dissolution of marriage is that an annulment treats a marriage like it has never existed.
  • The typical situation where an annulment occurs is after a marriage of a very short duration – the “Vegas Wedding” that both parties realize is a mistake after a week or so.
  • Most states require a divorce if the marriage has lasted more than a specified number of months or years.
  • Other than in these situations, an annulment can be treated similar to a divorce, in that child support and custody will come into play if children are involved in the marriage.

If you wish to end your marriage, you should speak to a lawyer about the options available to you. Your lawyer can advise you on what is best, given your particular situation.
