If you get married in the state of New York, and you decide that the marriage was a mistake, you may be able to get the marriage annulled.  An annulment is different from a divorce in that it makes the marriage null and void, as though it never happened.  There are a number of grounds for annulment, or circumstances under it is possible and permissible to get an annulment in New York.  The process of getting an annulment depends on one or more of these grounds being met.

The grounds for annulment are that one or both spouses:

  • Were under the age of 18 at the time of marriage, 
  • Are incapable of having sexual intercourse, 
  • Have become incurably insane for a period of at least five years, or 
  • Were coerced, threatened, or otherwise forced to enter the marriage contract.  

If one or more of these conditions apply, all you have to do to get an annulment is to visit the courthouse in your county or city and file the proper paperwork, along with proof of the conditions, and the court will make a ruling as to whether or not the marriage will be annulled by the court of New York.
