How soon after a divorce can one re-marry?

My husband and I just divorced after a year-long separation. I just received the final decree six months ago. During my separation, I met someone and now we are seriously discussing marriage. How long after the divorce do I have to wait to remarry?

Answers

Although generally, you don't have to wait to remarry, some states offer a waiting period to allow parties to appeal a divorce decree. Those states with waiting periods usually calculate the onset of the waiting period from the time the judge approves the final decree. Waiting periods vary from state to state. For example, Alabama has a 60-day waiting period while Nebraska has a 6-month period. Non-waiting states include Illinois, California, and New Mexico. If you remarry before a statutory waiting period has ended, your new marriage, although not void, is voidable by either party as not being legal. You should check with a lawyer to determine whether your state has a waiting period. It is safer to wait out this time to ensure that your second marriage is statutorily binding.
