The annulment of a marriage, which is a legal declaration that the marriage essentially never took place, is obtainable in Kentucky only under specific circumstances. So, what are the rules for how to get an annullment in Kentucky? The circumstances that can lead to an annulment are as follows:

  • If the marriage was obtained by means of force
  • If the marriage was obtained by means of fraud (this can include everything from the failure to disclose a sexually transmitted disease, to the failure to disclose an inability to have children, to the failure to disclose an addiction or inability to consummate the marriage)
  • If the married couple are related on a level closer than that of second cousins
  • If one of the couple is considered mentally disabled by a court judging his or her competence to make an informed decision
  • If one of the couple is already married to a living spouse and has not gone through a legal divorce
  • If the marriage was not legally authorized/ did not meet legal standards
  • If one of the couple was between the ages of 16 and 18 and did not have the required consent of parents or guardians
  • If one of the couple was under 16 and the marriage was not properly authorized/ permitted by a court judgment as required

Should any of the above circumstances be met, one or both of the parties in question can file a request for annulment; this must, however, take place within 90 days of discovering the grounds on which the annulment is sought.
