First, you need to be sure that you are moving forward in complete compliance with the terms of your lease with the tenant.
In general, the state of Georgia requires you to remove a tenant by filing a court action if the tenant has failed to vacate the premises after you have made a written demand that he or she do so.
As the landlord, you (or your agent or attorney) will need to go to the magistrate’s court and file what’s called a Dispossessory Affidavit. This statement must note the landlord’s name, the tenant’s name and why you are requiring the tenant to leave. It must also state that the landlord has made a demand, in writing, that the tenant leave and that the tenant has refused to leave. Finally, the affidavit must state if any rent is currently owed.
