Typically, visitation rights, as well as custody rights, are often dictated by the court in their final child support and custody decrees. If the court at that time decided that you were unfit to deserve visitation, you must petition the court to show that you have changed your ways and are able to either spend time with or support your child.
In California, you have three options when it comes to visitation; normal visitation or supervised visitation. Under normal visitation, you are given a specific time frame or amount of time allowed for time with your children. Based on your information, you might be challenged to have only supervised visitation, which requires either the other parent, another adult, or a professional agency provide supervision during your visits with your children.
You should speak with an experienced attorney specializing in divorce and child custody issues who can ensure your visitation rights with your children, and plan the best course of action for you.
