Since the laws are different from state to state regarding separation and divorce, I cannot comment on the specifics of your case, but in many states you being separated for a certain amount of time can be grounds to file for a divorce. I encourage you to talk to an attorney in your state when getting a separation especially where you are already thinking about a divorce after.
