In California and other states, the factors affecting both the duration and the amount of spousal support include but are not limited to the duration of the marriage and the length of the pre-divorce separation; the age of the parties at the time of the divorce; the relative income and future financial prospects of each spouse; and “fault” in the marital breakdown. Additionally, if your and/or your ex-wife’s financial circumstances change after the support award is in place you can petition the court to modify its terms.
A qualified divorce and/or family law attorney can advise you regarding California’s spousal support laws and their application to the facts of your case.
