I live in Tennessee and I am getting a divorce from my wife. She says she should keep the house, but I owned the house before we were married so I think I should keep the house. Who should get the house?

Since Tennessee is an equitable distribution state, the divorce court in Tennessee will decide which property is marital property and which property is separate and then divide it equally as they see fit. However, if you owned the house before you were married then you should be able to keep the house. Of course, you will need proof that you owned the house before marriage to prove that it is in fact yours. If I were you, I would also speak to a lawyer in your state that specializes in family law and divorce. He or she will be able to point you in the right direction of organizing all of your records to ensure that you keep the property that is rightfully yours.
